1. About These Terms

These Terms of Service (“Terms”) govern your access to and use of esthedepot.eu, its content, and purchases made from Esthe Depot.

2. Consumers and Business Customers

A consumer is a natural person acting for purposes outside their trade, business, craft or profession.

A business customer is a person or organisation purchasing wholly or mainly for professional or commercial purposes.

Certain consumer protections may also apply to natural persons conducting business where applicable Polish or other mandatory law grants them consumer-like rights.

Providing a business name, company details or VAT number may indicate a business purchase but does not by itself determine the customer’s legal status.

3. Website Use

You must be legally capable of entering into a contract and must use the website lawfully.

You must not:

misuse the website or introduce malicious software or code;
attempt unauthorised access to accounts, systems, networks or data;
use website content to impersonate Esthe Depot or mislead another person;
scrape, reproduce or commercially exploit protected website content without permission;
interfere with the security or normal operation of the website; or
use the website or our products for an unlawful purpose.

We may restrict or suspend access where reasonably necessary to protect customers, our systems, our rights or legal compliance.

4. Product Information

We aim to provide clear and accurate information about our products, including descriptions, photographs, prices, specifications, included accessories, availability and estimated delivery information.

Minor differences in colour, appearance, finish or packaging may occur because of screen settings, manufacturing updates or product improvements that do not materially affect the product’s intended function.

We may correct obvious typographical, pricing or technical errors.

If a material error affects an order that has already been accepted, we will contact the customer and provide an appropriate solution, including cancellation and refund where required by law.

The product information displayed at the time an order is placed forms part of the purchase information applicable to that order.

If a particular specification, function, accessory, certification, plug type, voltage or delivery date is essential to your purchase, please contact us before ordering and request written confirmation.

5. Professional Equipment and Operator Responsibility

Many products offered by Esthe Depot are intended for professional beauty, aesthetic or spa applications and may require appropriate operator training.

Customers are responsible for:

checking whether the equipment is suitable for their intended application;
reviewing and following the product manual, operating instructions, warnings and maintenance requirements;
using the correct voltage and appropriate electrical installation;
ensuring operators have any qualification, training, supervision, insurance, licence or authorisation required by applicable local law;
complying with applicable workplace, health, safety, advertising and professional-treatment requirements.

Product training provided by Esthe Depot is intended to explain equipment setup, controls and routine operation.

It does not constitute medical advice and does not replace any professional qualification, medical supervision, licence or government authorisation that may be required.

Nothing in this section limits our responsibility for product conformity, product safety or other obligations that cannot legally be excluded.

6. Orders and Contract Formation

Products displayed on our website constitute an invitation to place an order and do not themselves constitute acceptance of an order.

Before submitting an order, customers will be given the opportunity to review the products selected and the applicable price and charges.

After an order is submitted, we may send an electronic order acknowledgement.

A purchase contract is formed when we expressly accept the order, for example by issuing an order acceptance or dispatch confirmation.

We may decline or cancel an order before acceptance where, for example:

a product is unavailable;
there is an obvious pricing or description error;
payment cannot be authorised;
reasonable fraud or security checks are not satisfied;
the delivery destination cannot be serviced;
legal or regulatory restrictions prevent us from supplying the product.

If payment has already been received for an order that we cannot accept, the amount received will be refunded using an appropriate payment method.

7. Prices, VAT and Other Charges

The applicable currency and price will be displayed before the customer confirms an order.

Where products are offered to consumers, prices will include applicable taxes, including VAT where required by law, unless the nature of the displayed price is clearly indicated otherwise.

Delivery costs and other mandatory charges applicable to an order will be disclosed before the customer confirms the purchase.

Business customers may qualify for different VAT treatment where legally applicable.

Providing a VAT number does not automatically mean that an order qualifies for zero-rating, reverse-charge treatment or another tax exemption.

Customers are responsible for providing accurate billing and invoice information.

8. Payment

Payment must be made using a payment method available through checkout or otherwise expressly agreed by Esthe Depot.

Available payment methods may vary depending on the customer’s country, order value, currency and selected product.

Payment providers may carry out identity, payment, address, security or fraud-prevention checks.

We may also carry out reasonable verification checks before accepting or dispatching an order.

We do not ordinarily receive or store customers’ complete payment-card numbers where payment is processed directly by an external payment provider.

9. Product Availability

Product availability information is updated as reasonably possible.

Products marked as available or in stock remain subject to final verification before acceptance of the order.

Products identified as preorder, backorder, made-to-order or subject to a production lead time may have a longer estimated dispatch period.

Availability is not guaranteed until the order has been accepted.

If an accepted product becomes unavailable, we will contact the customer and provide an appropriate option, which may include:

a revised delivery estimate;
an alternative product, with the customer’s agreement; or
cancellation and refund.

10. Delivery

Processing times, estimated transit periods, shipping charges, freight conditions and other relevant delivery information are provided on our website, product pages, checkout or order documentation.

Delivery dates and transit times are estimates unless expressly confirmed as guaranteed.

For consumers, goods will be delivered within the period agreed with the customer. Where no specific delivery period has been agreed, applicable mandatory consumer delivery rules will apply.

For consumer purchases, risk of loss or damage normally passes when the consumer, or a third party designated by the consumer other than the carrier, takes physical possession of the goods, subject to applicable law.

For business customers, risk transfers in accordance with the delivery terms applicable to the order, quotation or separately agreed shipping arrangement.

Customers should inspect delivered goods as soon as reasonably possible and notify us promptly if packaging or products appear damaged.

11. Cancellations and Returns

Cancellation, return eligibility, return procedures, return shipping costs and refund timing are explained in the Refund and Return Policy applicable to the order.

Nothing in these Terms limits or excludes mandatory rights relating to faulty, unsafe, damaged, misdescribed or non-conforming goods, or any other rights that cannot lawfully be excluded.

12. Legal Conformity Rights and Commercial Warranty

Consumers have statutory rights where goods do not conform to the sales contract.

Under Polish consumer law, the seller is generally responsible for a lack of conformity existing at delivery and revealed within two years of delivery. Consumers may have rights including repair or replacement and, in circumstances provided by law, price reduction or termination of the contract.

Consumers in other European countries may have additional or longer mandatory protections under the law applicable to them.

Unless the relevant product information states otherwise, qualifying professional equipment may also include a three-year limited Esthe Depot commercial warranty on the main unit.

A commercial warranty is additional to statutory consumer rights and does not replace, restrict or reduce those rights.

Subject to applicable law and the applicable warranty terms, commercial warranty coverage may exclude:

consumables and normal wear items;
cosmetic wear that does not affect normal operation;
damage caused by misuse, impact, liquid exposure or unsuitable storage;
damage caused by incorrect voltage or unsuitable electrical supply;
failure to maintain or clean equipment according to instructions;
unauthorised modification, opening or repair;
use contrary to operating or safety instructions.

An exclusion does not apply where doing so would unlawfully restrict statutory rights.

We may reasonably request proof of purchase, the equipment serial number, photographs, videos or other diagnostic information to investigate a technical issue.

Any statutory remedy will be provided in accordance with applicable law.

13. Training and Digital Materials

Where a product includes online product training, manuals, operating materials or videos, these will be provided using the contact details associated with the order or another agreed method.

Training availability, language, scheduling and scope may vary according to the product.

Unless expressly stated otherwise, training is provided remotely.

Product training does not constitute certification by a governmental authority or medical organisation and does not replace any qualification required under applicable law.

Training materials and restricted documentation may not be reproduced, resold, uploaded publicly or commercially distributed without permission.

14. Intellectual Property

Unless otherwise stated, the website and its content, including text, graphics, photographs, videos, layouts, designs, logos, product names, training materials and software, are owned by or licensed to Esthe Depot and are protected by applicable intellectual-property law.

Customers may use the website for lawful personal or internal business purposes relating to evaluating or purchasing our products.

No ownership or broader intellectual-property licence is transferred unless expressly agreed in writing.

Third-party trademarks remain the property of their respective owners.

A reference to a technology, treatment category or compatible application does not imply an affiliation, sponsorship or endorsement by another brand unless expressly stated.

15. Reviews and User Content

If you submit a review, photograph, video or other content, you confirm that:

you have the right to submit the content;
statements about your experience are genuine and not intentionally misleading;
the content does not infringe another person’s rights;
the content does not improperly disclose confidential information or personal information about clients;
the content is not unlawful or defamatory.

We will use identifiable customer images or testimonials in advertising only where we have the permission or other lawful basis required by applicable law.

16. Third-Party Services and Links

Our website may contain links to payment providers, delivery companies, social-media services and other third-party websites or services.

Third-party providers operate under their own terms and privacy notices.

We are not responsible for the independent content or services of third parties except where responsibility cannot legally be excluded.

17. Liability

Nothing in these Terms excludes or limits liability where doing so would be prohibited by law.

In particular, nothing limits mandatory consumer rights or liability that cannot legally be restricted.

Consumers

For consumer customers, liability is determined in accordance with applicable mandatory consumer and contract law.

Nothing in these Terms excludes remedies available to consumers for non-conforming goods or other statutory rights.

Business Customers

For business customers, to the maximum extent permitted by applicable law:

neither party will be liable for indirect or consequential losses that were not reasonably foreseeable;
Esthe Depot will not be liable for loss of profit, revenue, business opportunity or goodwill arising solely from a commercial use of the equipment, except where such liability cannot legally be excluded;
any agreed contractual limitation will not apply where liability cannot lawfully be restricted.

Products must be used according to their stated intended use and applicable safety instructions.

Nothing in this clause excludes liability resulting from obligations that cannot legally be excluded or restricted.

18. Events Outside Reasonable Control

We are not responsible for delay or failure to perform an obligation where the delay or failure results from circumstances outside our reasonable control.

Such circumstances may include:

severe weather or natural disasters;
major carrier or transportation disruption;
strikes or industrial action;
governmental measures;
customs delays;
war or serious civil disturbance;
epidemics or public-health emergencies;
infrastructure or communications failures;
significant supply-chain interruption.

We will take reasonable steps to minimise disruption and, where appropriate, inform affected customers.

Mandatory consumer rights relating to delayed or failed delivery remain unaffected.

19. Complaints and Dispute Resolution

Please include your order number, where applicable, and sufficient information for us to investigate the matter.

We aim to acknowledge complaints promptly and respond after reasonable investigation.

Consumers may also have access to national consumer-protection authorities or appropriate alternative dispute-resolution entities.

The former European Commission Online Dispute Resolution (ODR) platform has been discontinued. We therefore do not provide or rely on the former ODR-platform link.

20. Governing Law and Courts

These Terms and contracts entered into with Esthe Depot are governed by Polish law, subject to mandatory applicable law.

For consumers, this choice of law does not deprive you of any mandatory consumer protection granted by the law that would otherwise apply, including mandatory protections of the country of your habitual residence where applicable.

Consumers may bring proceedings before any court available to them under mandatory applicable jurisdiction rules.

For business customers, unless mandatory law provides otherwise or the parties expressly agree otherwise, disputes will be subject to the jurisdiction of the courts competent for the registered office of Esthe Depot in Warsaw, Poland.

21. Severability

If any provision of these Terms is determined to be invalid, unlawful or unenforceable, that provision will be modified or disregarded only to the extent necessary.

The remaining provisions will continue to apply.

22. Changes to These Terms

We may update these Terms from time to time for future use of the website and future orders.

The Terms applicable to a purchase are generally the version presented or made available when the order is placed, unless a later change is required by applicable law or expressly agreed between the parties.

Updates to these Terms do not retrospectively remove mandatory customer rights.
