1. About These Terms

These Terms of Service (“Terms”) govern access to esthedepot.com, use of its content and purchases from Esthe Depot.

The website and online store are operated by:

By using the website or placing an order, you agree to these Terms and the policies linked from them. Mandatory rights that cannot lawfully be excluded remain unaffected.

2. Consumers and Business Customers

A consumer is a natural person acting for purposes outside their trade, business, craft or profession.

A business customer is a person or organisation purchasing wholly or mainly for professional or commercial purposes.

Some provisions and statutory rights apply only to consumers. Supplying a business name or VAT number may indicate a business purchase but does not by itself determine legal status.

3. Website Use

You must be legally capable of entering into a contract and must use the website lawfully.

You must not:

• misuse the website or introduce malicious code;
• attempt unauthorised access to accounts, systems or data;
• use website content to mislead customers or impersonate Esthe Depot;
• scrape, reproduce or commercially exploit protected content without permission;
• use the website or products for an unlawful purpose.

We may suspend access where reasonably necessary to protect customers, systems, rights or legal compliance.

4. Product Information

We aim to provide accurate descriptions, photographs, prices, specifications, included accessories, availability and delivery information.

Screen settings and production updates may cause minor differences in colour or appearance. We may correct an obvious typographical, pricing or technical error before accepting an order. If an error affects an accepted order, we will contact the customer and provide an appropriate option, including cancellation and refund where required.

The product page applicable when the order is placed forms part of the contract. If a particular function, certification, accessory, plug, voltage or delivery date is essential, ask us to confirm it in writing before ordering.

5. Professional Equipment and Operator Responsibility

Many products sold by Esthe Depot are intended for trained professional use.

The customer is responsible for:

• checking whether a product is suitable for the intended professional service;
• following the manual, safety instructions, contraindications and maintenance requirements;
• using the correct voltage and electrical installation;
• ensuring operators have the qualifications, training, supervision, insurance or licence required locally;
• complying with workplace, product, health, advertising and treatment rules in the country of use.

Product training supplied by Esthe Depot explains equipment operation. It is not medical advice and does not replace a professional qualification or governmental authorisation.

Nothing in this section limits Esthe Depot’s responsibility for product conformity, safety or other obligations that cannot lawfully be excluded.

6. Orders and Contract Formation

Products displayed on the website are an invitation to place an order, not an automatic acceptance.

After an order is submitted, we send an electronic acknowledgement. A purchase contract is formed when we send an order acceptance or dispatch confirmation, or otherwise expressly accept the order.

We may decline or cancel an order before acceptance where, for example:

• the product is unavailable;
• the price or description contains an obvious error;
• payment is not authorised or fraud checks are not satisfied;
• the delivery destination is unsupported;
• a legal or product restriction prevents supply.

If payment has been received for an order we cannot accept, it will be refunded.

7. Prices, VAT and Other Charges

The currency and price applicable to the selected market are displayed before purchase.

Prices offered to consumers include applicable VAT unless clearly stated otherwise. Delivery and optional service charges are displayed before the customer confirms the order.

Verified business customers may be eligible for different VAT treatment where legally applicable. A valid VAT number does not automatically guarantee zero-rating or reverse-charge treatment. Contact us before ordering if a specific VAT treatment is required.

The customer is responsible for providing accurate invoice information.

8. Payment

Payment must be made using a method available at checkout or separately approved by Esthe Depot.

Payment options, authorisation, bank transfers, currency and security are explained on the Payment Method page. We may carry out reasonable identity, address and fraud checks before accepting or dispatching an order.

9. Product Availability

Availability displayed on the product page and checkout is updated as reasonably possible.

An item marked in stock is available for order subject to final verification. An item marked preorder or backorder will display an expected dispatch date or lead time. We do not guarantee availability until the order is accepted.

If an accepted product becomes unavailable, we will contact the customer and offer a suitable remedy, which may include a revised delivery date, alternative product or refund.

10. Delivery

Processing periods, transit estimates, shipping charges, freight conditions, tracking, customs and damaged-delivery procedures are set out in the Shipping & Delivery page.

Consumers will receive goods within the agreed delivery period. If no specific period has been agreed, mandatory statutory delivery rules apply.

Risk of loss for a consumer normally passes when the consumer or nominated recipient, other than the carrier, takes physical possession. Risk for a business customer passes as agreed in the order, quotation or applicable delivery terms.

11. Cancellations, Withdrawal and Returns

Consumer withdrawal rights, the additional 30-day commercial return option, business returns, exclusions, return costs and refund timing are explained in the Refund and Return Policy.

No provision in these Terms limits mandatory rights relating to faulty, unsafe, damaged, misdescribed or non-conforming goods.

12. Legal Guarantee and Commercial Warranty

EU consumers have a minimum two-year legal guarantee of conformity for new goods, subject to applicable national law.

Unless the product page states otherwise, qualifying professional equipment also includes a three-year limited Esthe Depot commercial warranty on the main unit. The commercial warranty is additional to, and does not replace or reduce, mandatory consumer rights.

Commercial warranty coverage may exclude, to the extent permitted by law:

• consumables and normal wear items;
• cosmetic wear that does not affect function;
• damage caused by misuse, impact, liquids or improper storage;
• incorrect voltage, overloaded circuits or unsuitable electrical supply;
• failure to maintain or clean the product as instructed;
• unauthorised modification, opening or repair;
• use contrary to the manual or safety instructions.

An exclusion does not apply where the claimed problem was caused by an existing lack of conformity or where excluding liability would be unlawful.

Proof of purchase, the serial number and reasonable diagnostic information may be required. Repair, replacement or another remedy will be selected in accordance with applicable law and the warranty terms.

13. Training and Digital Materials

Where the product page states that online training, manuals or videos are included, access will be provided using the contact details associated with the order.

Training availability, language, scheduling and scope may vary by product. Unless expressly stated otherwise, training is remote and does not include on-site installation or certification by a governmental or medical authority.

Customers must not reproduce, resell or publicly distribute restricted training materials without permission.

14. Intellectual Property

The website, text, graphics, photographs, videos, designs, logos, product names, training materials and software are owned by or licensed to Esthe Depot and are protected by intellectual-property law.

Personal, non-commercial viewing of the website is permitted. No other licence is granted unless agreed in writing.

Third-party trademarks remain the property of their respective owners. Reference to a technology or compatible treatment category does not imply affiliation with another brand unless expressly stated.

15. Reviews and User Content

If you submit a review, photograph, video or other content, you confirm that:

• you have the right to submit it;
• it is accurate to your genuine experience;
• it does not infringe another person’s rights or disclose confidential or client information;
• it is not unlawful, defamatory or misleading.

We will use personal images or testimonials for advertising only with the permission required by applicable law.

16. Third-Party Services and Links

The website may link to payment providers, carriers, social platforms or other third-party services. Third parties operate under their own terms and privacy notices.

Esthe Depot is not responsible for an independent third party’s content or service, except to the extent responsibility cannot legally be excluded.

17. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, deliberate misconduct, death or personal injury caused by negligence, or mandatory consumer rights.

For consumers, Esthe Depot is responsible for foreseeable loss caused by our breach of contract or failure to use reasonable care and skill. We are not responsible for a consumer’s business losses.

For business customers, to the maximum extent permitted by law:

• neither party is liable for indirect or consequential loss, loss of profit, revenue, business, goodwill or opportunity;
• Esthe Depot’s aggregate contractual liability relating to an order is limited to the amount paid for the product giving rise to the claim;
• the limitations do not apply to liability that cannot legally be limited.

Products must not be used outside their stated intended use or contrary to safety instructions. Esthe Depot is not responsible for loss caused by unauthorised modification, unsafe operation or failure to follow the manual, except where such limitation would be unlawful.

18. Events Outside Reasonable Control

We are not responsible for delay or failure caused by events outside reasonable control, such as severe weather, carrier disruption, industrial action, government action, customs delay, epidemic, conflict, infrastructure failure or supply interruption.

We will take reasonable steps to reduce the effect and inform affected customers. Mandatory rights relating to prolonged delay remain unaffected.

19. Complaints

Please send complaints to info@esthedepot.eu with the order number and a clear description of the requested resolution.

We aim to acknowledge complaints promptly and provide a substantive response after reasonable investigation. Consumers may also use an applicable national consumer-protection or alternative dispute-resolution body where available.

20. Governing Law and Courts

These Terms and contracts with Esthe Depot are governed by Polish law.

If you are a consumer resident in another EU or EEA country, this choice does not deprive you of mandatory protections available under the law of your habitual residence. A consumer may bring proceedings in any court available under mandatory applicable law.

For business customers, the courts with jurisdiction over the registered office of ESTHE DEPOT sp. z o.o. have exclusive jurisdiction unless the parties agree otherwise in writing.

21. Severability

If a provision is found invalid or unenforceable, it will be adjusted or removed only to the extent necessary. The remaining provisions continue in effect.

22. Changes to These Terms

We may update these Terms for future website use and orders. The version applicable to a purchase is the version presented when the order is placed, unless a change is required by law or expressly agreed.
